Gusi Portfolio Tracker terms of service

Who this is between

These terms are an agreement between you and Gusi Studios LLC, 2200 W 4th St. Apt. B, Hattiesburg, Mississippi 39401, United States. They apply when you use Gusi Portfolio Tracker, on any platform. If you do not accept them, do not use the app.

This is not investment advice

This is the most important section on the page, so it is near the top rather than buried at the bottom.

Gusi Portfolio Tracker is an information tool. It records what you tell it, imports what your broker reports, and draws what follows arithmetically from price history. Nothing in it is investment advice, a recommendation, a solicitation, or an opinion that you should buy, sell or hold anything. We are not a broker, a dealer, an investment adviser or a financial planner, and nothing here creates a fiduciary or advisory relationship of any kind.

Supply and demand zones and trend lines are interpretations of past prices produced by a rule you configure. They have no predictive value and no authority. A zone is not a signal. A broken trend line is not an instruction. Every decision you make with your money is yours, and you should take professional advice about it if you need it.

When you created your account you accepted a specific, dated version of our risk disclaimer, and that is the version that applies to you. It is shown in the app, its version is recorded against your account, and every alert we send cites the version in force when it was sent. If it is ever updated, you will be asked to accept the new one rather than being deemed to have agreed to it.

Who may use it

You must be at least 18 years old. You must be allowed, where you live, to hold the accounts you connect and to use a service like this one. You are responsible for keeping your password to yourself and for everything done through your account.

Market data, and what it is worth

Prices, company information and filings come from third parties, currently EODHD, Yahoo Finance, Financial Modeling Prep and the SEC's EDGAR system. That data may be delayed, incomplete, or simply wrong, and we do not control it and cannot correct it at source. Figures in the app are for information, not for settlement, tax or accounting, and they are not a substitute for your broker's own statements, which are the record that counts.

Anything the app derives from that data, including performance, realised gains and reports, inherits whatever is wrong with it.

Connecting a broker

Brokerage connections are made through SnapTrade, on SnapTrade's own portal. Your brokerage credentials go to them and never to us, and their terms and privacy policy apply to that part.

The connection is read-only. The app imports positions and transactions so it can show them to you. It never places, changes or cancels an order, and it never moves money. Your agreement with your broker is unaffected and continues to govern your account. You can disconnect at any time in the app, and deleting your account removes the connection at SnapTrade as well.

Notifications are best effort

The app can email or push you when price enters a zone you are watching or breaks a trend line. Do not rely on them. They depend on market data arriving, on scheduled jobs running, and on email and push services outside our control, any of which can fail.

Two behaviours are worth knowing because they are deliberate rather than accidental. Each zone alerts once, ever, rather than repeating daily. And an alert that could not be delivered within 24 hours is closed unsent rather than sent late, because a message about yesterday's price is worse than no message. A notification that never arrives is not a breach of these terms, and we are not liable for what you did or did not do because of one.

Households

You can share a household with other people. What you share becomes visible to the other members, and the app shows you what each choice means before you make it. Share only with people you would show a brokerage statement to.

Your data stays yours. If you leave a household, your positions, watchlist and notes leave with you. If you delete your account, they are deleted rather than left behind, and the other members stop seeing them.

Subscriptions and payment

Some features need a paid plan. Subscriptions are sold and billed by Apple or Google through the store you bought from, under that store's own terms, and they renew automatically until you cancel.

Cancel in your App Store or Google Play settings, not here, and not by deleting the app or your account. Deleting your account removes your access but does not cancel a store subscription and does not refund one. Refunds are the store's to give under its own policy. If prices change, the change applies to renewals after we have told you, never retrospectively.

Using it properly

Do not try to break into other people's data, attack or overload the service, scrape or resell the market data that reaches you through the app, take it apart to extract its source, or use it to do something illegal. Do not connect an account that is not yours.

Who owns what

The app, its design and its code are ours. What you put into it is yours, and we claim no ownership of it; we hold it only to run the service for you, as described in the privacy policy.

Ending it

You can stop at any time and delete your account from inside the app. We can suspend or close an account that is being used to break these terms, to harm other users, or where the law requires it. If we do that without cause, we will refund the unused part of a subscription we billed.

What we do not guarantee

The app is provided as it is. We do not promise it will be uninterrupted, error free, or available at any particular moment, and we do not promise that the data in it is accurate or complete. To the extent the law allows, we exclude implied warranties.

To the extent the law allows, we are not liable for trading or investment losses, lost profits, or indirect or consequential loss, and our total liability to you for anything arising out of the app is limited to what you paid us in the twelve months before the claim. Nothing here excludes liability that cannot lawfully be excluded, including for fraud, and if you are a consumer, nothing here takes away rights your local law gives you.

Changes

We may change the app, and we may change these terms. If a change matters to you, we will tell you in the app before it takes effect rather than relying on you to notice a new date at the top of this page. Carrying on using the app after that is how you accept it. If you would rather not, stop using it and delete your account.

Which law applies

These terms are governed by the laws of the State of Mississippi, United States, and the courts of Mississippi have jurisdiction.

If you are a consumer in the European Economic Area, the United Kingdom or Switzerland, this does not take away the protection of the mandatory laws of the country you live in, and you can still bring proceedings in your own courts. We are not obliged to take part in dispute resolution before a consumer arbitration board, and would rather you wrote to us first.
